These Terms and Conditions govern the booking and provision of tourism services offered by Tierras de los Andes S.A.C., operating commercially under the name Tierras de los Andes.
Our goal is to ensure that every traveler has clear information about the general conditions applicable before booking a tour, package, excursion, or any other tourism service with us.
By booking a service, the traveler acknowledges having received or had access to the information corresponding to the selected service and accepts the specific conditions communicated in connection with the booking.
These terms apply together with our Booking Policy, Payments and Deposits Policy, Cancellation and Refund Policy, and any other specific conditions applicable to the contracted service.

Tierras de los Andes S.A.C. carries out its activities in accordance with Peruvian regulations applicable to travel agencies, tourism services, and consumer protection.
Tierras de los Andes organizes, markets, and coordinates different tourism experiences and services which, depending on the contracted program, may include:
tours and excursions;
travel packages;
cultural and nature visits;
guiding services;
tourist transportation;
accommodation;
train tickets;
admission tickets to tourist attractions;
services related to Machu Picchu;
trekking and nature activities;
transfers;
services provided by specialized tourism operators or service providers; and
other components expressly indicated in the program or quotation.
Each service may have different characteristics and conditions.
For this reason, before making a booking, we recommend reviewing the description, duration, included and excluded services, difficulty level where applicable, requirements, availability, and any other information provided for the selected experience.
An inquiry or quotation request does not, by itself, constitute a confirmed booking.
When a traveler expresses interest in one of our services, Tierras de los Andes may verify availability, request the necessary information, and provide a proposal or instructions on how to continue with the booking process.
A booking will be considered confirmed when Tierras de los Andes has expressly communicated its confirmation and the conditions applicable to the contracted service have been fulfilled, including any applicable payment requirements.
Confirmation may be provided by email, written communication, receipt, booking system, or another method used by Tierras de los Andes.
Specific conditions regarding deposits, payments, and confirmation are explained in our corresponding policies.
Tourism services are subject to availability at the time the booking is made.
The publication of a tour, date, or service on our website does not necessarily mean that immediate availability exists.
Certain services have limited capacity or depend on availability managed by third parties, particularly when they involve:
admission tickets to tourist attractions;
Machu Picchu;
the Inca Trail or other regulated routes;
trains;
flights;
accommodation;
transportation;
events;
permits; or
external service providers.
Tierras de los Andes will confirm availability according to the information available at the time the request is processed.
The traveler is responsible for providing accurate, complete, and up-to-date information whenever required to make a booking.
This may include names, contact details, and any other information necessary according to the contracted service.
Certain services may require additional information due to requirements related to tickets, transportation, permits, accommodation, or other providers.
It is important to carefully review the information before confirming a booking, especially when services are issued in a passenger's name or are otherwise nominative, as subsequent changes may be subject to availability, provider conditions, or additional costs.
If the traveler identifies an error, they must notify Tierras de los Andes as soon as possible.
Prices will be those published, quoted, or confirmed for each service at the corresponding time.
A quotation may take into account factors such as:
number of travelers;
season;
availability;
service category;
accommodation;
transportation;
admission tickets;
additional services; and
specific itinerary characteristics.
Before confirming a booking, Tierras de los Andes will endeavor to clearly communicate the applicable price and the main services included and excluded.
When a quotation has a specified validity period, this will be communicated to the traveler.
Payments, deposits, accepted currencies, and other financial conditions are covered in the Payments and Deposits Policy.
Each program, tour, or quotation will specify the services included in the price.
Travelers should carefully review the “included” and “not included” sections, or equivalent information, before booking.
Unless expressly stated otherwise, personal expenses and additional services requested directly by the traveler are not included in the original price.
If the traveler voluntarily requests additional services during the trip, these may generate separate costs.
To organize a tourism experience, Tierras de los Andes may coordinate services provided by hotels, transportation companies, tour operators, railway companies, airlines, restaurants, guides, attraction administrators, and other specialized service providers.
Tierras de los Andes selects and coordinates these services with the aim of ensuring that they are suitable for the contracted program and carries out the arrangements corresponding to its role as an agency or organizer.
Each provider may be subject to its own operating conditions, schedules, regulations, and policies.
If an incident occurs involving a provider included in a service contracted through Tierras de los Andes, we will provide the assistance and management reasonably corresponding to our responsibilities, without limiting the rights granted to consumers by applicable law.
Published itineraries and schedules represent the planned arrangements for each service.
However, tourism activities may be affected by circumstances requiring reasonable adjustments to schedules, order of visits, routes, or certain components of the program.
Such changes may occur, for example, due to:
weather conditions;
roadblocks or road restrictions;
orders issued by authorities;
closure of attractions;
changes to train or transportation schedules;
ticket availability;
safety conditions;
social events;
natural circumstances; or
situations reasonably beyond the control of Tierras de los Andes.
Whenever possible, travelers will be informed of significant changes and reasonable alternatives will be sought to allow the service to continue.
Traveler safety will take priority when operational decisions are made.
If, after confirming a booking, the traveler wishes to change:
the date;
number of participants;
names;
itinerary;
accommodation;
transportation;
contracted service; or
any other component,
they must contact Tierras de los Andes as soon as possible.
We will make reasonable efforts to process the requested change.
However, all changes are subject to availability and the conditions applicable to the services involved.
Certain providers, tickets, permits, or transportation services may apply fare differences, restrictions, or specific conditions for modifications.
Before making a change that generates an additional cost, the traveler will be informed whenever that cost can reasonably be determined in advance.
If the traveler voluntarily modifies, interrupts, or chooses not to use a service after the trip has begun, they should notify Tierras de los Andes so that the available alternatives can be evaluated.
Services that have already been confirmed, used, issued, or committed with providers may be subject to the particular conditions established by those providers.
The financial consequences of a modification, interruption, or voluntary abandonment will be determined in accordance with the Cancellation and Refund Policy, the specific conditions of the booking, and the nature of the affected services.
Exceptional or unavoidable events may occur that affect the normal operation of a trip.
These may include, among others:
natural events;
severe weather conditions;
public health emergencies;
social unrest or conflicts;
strikes;
blockades;
road closures;
government restrictions;
widespread transportation cancellations; or
events reasonably beyond the control of the parties.
When such a situation affects a service, Tierras de los Andes will assess the existing circumstances and seek to offer reasonable alternatives, taking into consideration traveler safety, availability, and the conditions of the providers involved.
Where rescheduling, cancellation, or reimbursement is appropriate, the booking conditions and our Cancellation and Refund Policy will apply.
To contribute to the proper provision of the services, travelers must:
provide accurate booking information;
comply with communicated schedules;
follow reasonable instructions from the guide, coordinator, or responsible provider;
respect the rules of the places visited;
behave respectfully toward other travelers, workers, and local communities;
protect cultural and natural heritage;
use the services and facilities provided appropriately;
carry the documentation required for each activity; and
communicate any relevant circumstance that may affect the safe provision of the service.
For nature activities, trekking, or services requiring a certain level of physical condition, travelers should review the published characteristics and difficulty level beforehand.
Travelers are responsible for having valid identification and travel documents for the destinations included in their program.
Depending on nationality and itinerary, these may include:
national identity document;
passport;
visas;
authorizations for minors;
immigration permits; or
documentation requested by competent authorities.
Immigration requirements may vary depending on the traveler's nationality, destination, and individual circumstances.
We therefore recommend checking current requirements with the relevant official authorities before traveling.
Tierras de los Andes may provide general guidance, but responsibility for possessing the required personal documentation remains with the traveler.
Some experiences may take place at high altitude, in rural areas, natural environments, or regions located far from urban centers, so travelers should carefully consider the characteristics of the service before booking.
Where a service has particular physical requirements, these will be indicated whenever appropriate in the corresponding information.
Travelers should promptly communicate any relevant condition that needs to be considered for the proper provision of the service.
If there is any doubt about fitness to participate in an activity, we recommend consulting a healthcare professional beforehand.
These recommendations do not replace a medical assessment.
We recommend that travelers obtain travel insurance appropriate to the characteristics of their itinerary, especially for multi-day programs, adventure activities, or trips involving multiple services and transfers.
Depending on the selected policy, travel insurance may provide coverage for situations such as medical treatment, accidents, interruptions, or other contingencies.
If insurance is expressly included in the contracted service, this will be indicated in the corresponding information.
If it is not included, the traveler may purchase it independently.
Travelers are responsible for the ordinary care of their luggage, documents, money, electronic devices, and other personal belongings during the trip.
When luggage is temporarily handed over to a transportation company, accommodation provider, or another service provider, the conditions applicable to that service and relevant regulations may also apply.
In the event of loss, damage, or another incident, Tierras de los Andes will provide reasonable guidance and assistance according to the circumstances.
Tierras de los Andes promotes responsible, respectful, and sustainable tourism.
We expect our travelers to respect:
local communities;
their customs and traditions;
cultural heritage;
natural areas;
wildlife and plant life;
the rules of tourist attractions; and
conservation and safety instructions.
Our services may not be used to carry out activities contrary to applicable law or that violate the rights of others.
Tierras de los Andes S.A.C. carries out its activities with an approach based on the protection of children and adolescents and rejects any form of exploitation related to tourism activities.
Tierras de los Andes promotes responsible tourism and compliance with the applicable provisions in this area.
Personal data provided during an inquiry, quotation, booking, or provision of services will be processed in accordance with our Privacy and Personal Data Protection Policy and applicable Peruvian regulations.
The information will be used for purposes related to the request and contracted services, as well as for other purposes that have been properly communicated and authorized when applicable.
The conditions applicable to cancellations, change requests, rescheduling, no-shows, or refunds are set out in our Cancellation and Refund Policy.
Conditions may vary depending on the timing of the request and the nature of the affected service, particularly where tickets, permits, transportation, accommodation, or other third-party services have already been issued or confirmed.
Before booking, we recommend reviewing that policy together with the specific conditions of the selected service.
Conditions related to:
deposits;
payments;
outstanding balances;
available payment methods;
verification of transactions; and
other financial conditions

Travelers should use only the payment methods and instructions provided or confirmed through the official channels of Tierras de los Andes.
The general procedures relating to requests, confirmation, availability, required information, and booking conditions are explained in our Booking Policy.
Where a product has a specific condition, it will be communicated in the service description, quotation, or corresponding communication.
Campaigns, discounts, and promotions may be subject to specific conditions, such as:
validity period;
availability;
travel dates;
number of available places;
included services;
restrictions; or
specific promotional conditions.
Where a promotional campaign exists, its conditions should be reviewed in the corresponding Promotions Terms and Conditions.
A promotion does not automatically modify the conditions of bookings made previously unless expressly stated otherwise.
We endeavor to keep the information provided by Tierras de los Andes accurate, clear, and up to date.
However, schedules, prices, availability, requirements, services, or conditions may change as a result of provider updates or external regulations.
Where there is a material difference between previously published general information and a specific condition confirmed for a booking, the information communicated and accepted for that particular booking will be taken into account, while always respecting consumer rights.
Communications regarding a request or booking may be made through the contact methods provided by the traveler, including email, telephone, or WhatsApp.
Travelers should ensure that their contact details are accurate and review communications related to their service.
To protect our customers, we recommend making payments, submitting information, or confirming changes only through the official channels of Tierras de los Andes.
If a traveler believes that there is an issue with our services, we recommend notifying us as soon as possible so that we can review the situation and seek a solution.
Tierras de los Andes S.A.C. also provides a Complaints Book, in accordance with Peruvian consumer protection regulations.
The use of our customer service channels does not limit any rights available to consumers under applicable law.
Tierras de los Andes will assume the responsibilities that correspond to it according to the nature of the contracted services and applicable law.
Nothing contained in these Terms and Conditions should be interpreted as a waiver or limitation of the rights granted to consumers under Peruvian law.
Where an incident is attributable to a service contracted and managed by Tierras de los Andes, the circumstances will be reviewed and appropriate assistance will be provided.
These Terms and Conditions are interpreted in accordance with the laws in force in the Republic of Peru, including provisions applicable to tourism services, travel agencies, and consumer protection.
Tourism services are provided within the framework established by the New General Tourism Law, Law No. 32392, its Regulations, and the provisions applicable to travel and tourism agencies.
Any provision of these terms must be interpreted in a manner that respects consumer rights under the Consumer Protection and Defense Code and other applicable regulations.
Tierras de los Andes may update these Terms and Conditions due to regulatory, operational, or service-related changes.
Updates will be published on this page.
Changes will not retroactively affect conditions already confirmed for a booking where doing so could prejudice rights already acquired by the consumer, except where applicable law or a valid agreement between the parties provides otherwise.
